EVALUATIVE MEDIATION - 25/09/2012

This descriptive indicates that type of mediation where the mediator sees fit to offer or supply (upon request) an opinion on the merits of a party's case and/or that of both parties, should the dispute proceed to a fully litigated hearing.

Put simply the parameters are:

"A Mediator should never provide an opinion or advice concerning the merits of a case"

verses

"a Mediator should always offer an evaluative opinion on the dispute"

It may thus be seen that... as at 2005 this school of thought had it as an issue of ethics, the proposition that the Mediator should be wary of evaluation on merits even when specifically requested by the parties so to provide a view.
